Virginia, but some charges were dropped

 

Why did they win?

Defendant tried free speech – didn’t work his speech was commercial. Defendant tried Virginia can’t charge me – didn’t work because of long arm.

Defended tries vague anti spam statute – court appealed because it prohibited all types of speech. There was a right to anonymous speech, which was prohibited by statute.
